Britney Spears’s father Jamie asks a judge to end the conservatorship immediately

Britney Spears on Tuesday accused her mother Lynne of being the architect of the conservatorship that has restricted her every move for the last 13 years, fuming in an angry Instagram post: ‘You know exactly what you did.’

Spears, 39, swiftly deleted the text, in which she launched an astonishing attack on her mother.

Lynne Spears has tried to take Britney’s side in her row with her father Jamie, Lynne’s ex-husband, over the conservatorship.

But the singer has repeatedly rejected her overtures, and on Tuesday said her mother was the true villain in the sorry saga. 

‘My dad is not smart enough to ever think of a conservatorship,’ Britney said.  

The singer posted a message on Instagram reading: ‘The most dangerous animal in the world is a silent smiling woman’.

She captioned the image: ‘My dad may have started the conservatorship 13 years ago … but what people don’t know is that my mom is the one who gave him the idea.

‘I will never get those years back. 

‘She secretly ruined my life … and yes I will call her and Lou Taylor out on it … so take your whole ‘I have NO IDEA what’s going on’ attitude and go f*** yourself!!!!’

Taylor is Spears’s former business manager. 

She continued: ‘You know exactly what you did … my dad is not smart enough to ever think of a conservatorship.’

Spears then deleted the post, and replaced it with one which appeared to be celebrating the news that her father has formally requested an end to her conservatorship, telling the judge in Los Angeles that he is abandoning his role immediately and does not want further payment.

‘It was a family business before … it’s no longer that anymore !!!!’ said Britney, in the updated post – which had edited out the attack on her mother.

‘I was BORN today cause I get to SMILE … so thank you for exiting out of my life and finally allowing me to live mine !!!!

‘Psssss do I know how mean I sound ??? Yes … I 100 billion percent I do.’

Lynne Spears in July issued a sworn statement in support of her daughter’s attempts to remove her father as conservator.

‘It is clear to me that James P. Spears is incapable of putting my daughter’s interests ahead of his own on both a professional and a personal level,’ she said. 

Yet Jamie hit back, accusing Lynne of being an absent mother and claiming she was paid $150,000 a year by Britney for her mansion in Louisiana. 

‘In stark contrast, it appears that Lynne is the one who is incapable of putting her daughter’s interests ahead of her own,’ Jamie Spears’ statement said. 

‘Lynne has not been involved in her daughter’s life for most of the past twelve years.

‘Despite their estranged relationship, the Conservatorship Estate, during the entire duration of the Conservatorship, has paid and continues to pay for the mansion in Louisiana where Lynne lives, including all of her utility bills, weekly maid service, and all maintenance (totaling upwards of $150,000 per year and to date, nearly $2,000,000 in total).’  

Britney’s accusations against her mother came as her father made his strongest move yet to end the arrangement. 

Jamie Spears, 69, on September 7 filed a petition to end the conservatorship.

On Tuesday he told Judge Brenda Penny that he was formally withdrawing from the arrangement, saying he was exhausted by the legal wrangling.

In the court documents, obtained by TMZ, his lawyers wrote: ‘Jamie unconditionally loves and supports his daughter. Full stop.

‘As he has done for her entire life, Jamie will do everything he can to protect and care for her.

‘For the last 13 years, that included serving as her Conservator. Now, it means ending her Conservatorship.’

He said that he was handing over all his files and documentation to his daughter’s legal team, regardless of the judge’s ruling, because he wanted nothing more to do with it.

He also emphasized that he was not seeking any more money. Jamie Spears had been paid $16,000 a month for managing his daughter’s $60 million estate.

‘This conservatorship should end. Now,’ his lawyers wrote.

‘There is no reason for another second of delay. Jamie is willing to stipulate to the immediate termination of the Conservatorship without reservation or exception.’

Judge Penny formally removed Jamie Spears as the controller of her estate on September 29.

‘The current situation is not tenable,’ she added before also ordering that control of all of the singer’s assets be turned over to a court-appointed temporary conservator – a certified public accountant named John Zabel.

Her lawyer Mathew Rosengart is attempting to depose the singer’s father, accusing him of mismanaging her affairs and abusing his position.

Rosengart on October 1 filed a request to have Jamie deposed and questioned the Louisiana-born businessman’s motivation for ending the conservatorship.

What is a conservatorship?

A conservatorship is a legal concept whereby a probate court appoints a person to manage an incapacitated person or minor’s financial and personal affairs.

It is often a relative. The terminology and details vary state-by-state, but the general principals are all similar.

The conservator’s duties include overseeing finances, medical care and living arrangements.

In Britney’s case, the conservators also oversee visitation arrangements with her two teenage sons, who are under the full custody of her ex-husband, Kevin Federline. It is most frequently used for someone who is severely mentally incapacitated, or suffering from dementia.

Yet in the 13 years of Britney’s conservatorship, she has released four albums – two of them going platinum; appeared as a judge on both The X Factor and American Idol; and had a four-year residency in Las Vegas that reportedly grossed close to $138 million.

The specific details of Britney’s case have not been revealed. Unless a judge says otherwise, they still retain rights to make certain decisions, according to the California handbook.

They can control salaries they earn, spend an allowance, retain legal representation, vote in elections, get married, draft their own wills, make medical decisions for themselves and ask a judge to terminate conservatorships or replace their guardians.

‘All conservatees have the right to be treated with understanding and respect and to have their wishes considered. They have all basic human rights, as well, and the right to be well cared for by you,’ the California handbook says.

Britney says that she has not had these rights. It is unclear whether this is a violation of her case, or as agreed.

There are two types of conservators: a conservator of the person, who looks after meals, housekeeping, transport, housing and recreation, and a conservator of the estate who manages finances and protects assets. Sometimes one person can play both roles.

The conservator of the estate must file periodic activities reports by the first year after their appointment and every two years following, until the relationship is terminated.

The estate managers have to disclose asset values, gains and losses, and show receipts for all expenditures of conservatorship funds. They are also prohibited from borrowing money from the conservatee or lending out their cash. Many countries have similar systems.

In the U.K. it is called a deputyship. In Britain, however, the court will appoint an independent conservator, rather than a family member.

He asked whether Jamie was ‘motivated by a desire to bolster his reputation or to avoid his deposition or responding to the outstanding discovery served on him in August.’

In his discovery request, Rosengart, who took over in July as Britney’s lawyer, is seeking all documents regarding communications between Jamie and management company Tri Star; all documents regarding any agreements between Jamie and Tri Star; all communications regarding payments made to Tri Star from the estate; and all payments made by the estate for legal services provided to Tri Star.

Rosengart also seeks to ask Jamie under oath how much money he has received from his daughter’s estate since the conservatorship’s inception in 2008.

The lawyer is further requesting all documents and communications relating to the electronic surveillance of Britney’s personal telephone and the placement of any recording devices in her home.  

Britney’s next court hearing is set for November 12, and it’s expected to focus on the potential termination of her conservatorship, which the 39-year-old also filed a petition in September to end.

‘After more than a decade, the time has come for Ms. Spears’s freedom,’ Rosengart said in the court documents.

‘Ms. Spears has made her wishes known about ending the conservatorship she has endured for so long and she has pleaded with this Court to ‘let her have her life back,’ without an evaluation, recently attending two Court hearings and asking this Court directly to end the conservatorship.

‘It is respectfully submitted – with the consent of all parties – that the time has come.’

Spears and her fiancé Sam Asghari were spotted house hunting on October 20 as she continues to make strides in regaining her freedom.

The pair looked at a $16.5 million mansion in the upscale Hidden Hills neighborhood in Calabasas, which currently belongs to makeup mogul Jeffree Star. 

Spears and Asghari were seen arriving at the private entrance to the Hidden Hills estate, only accessible to its A-list residents, including Drake, the Kardashians and Miley Cyrus.  

The house, purchased by Star in 2019 for $14.6 million, has seven bedrooms, 13 bathrooms and boasts sweeping views of the Southern California hills.  

The pop singer, who has been performing since she was a child, has been battling for the last two years to free herself from a conservatorship imposed in 2008, when she had a mental breakdown.

Criticism of the arrangement has grown, with the singer and her supporters arguing that it may have been initially useful, but had long outgrown its purpose.

Jamie Spears was being paid $16,000 a month to manage his daughter’s affairs, while she was touring and raking in millions.

‘I just want my life back,’ Spears said in court back in June. 

‘And it’s been 13 years and it’s enough. It’s been a long time since I’ve owned my money.

‘And it’s my wish and my dream for all of this to end without being tested.’

On August 12, amid mounting pressure from his daughter, his ex-wife Lynne and Britney’s fans, Jamie Spears agreed to step down – but only when everything was in place. He did not indicate how long that would be. 

On September 7, the Louisiana-born father of three said he accepted the moment was now, and defended his work over the past 13 years.

‘The conservatorship has helped Ms. Spears get through a major life crisis, rehabilitate and advance her career, and put her finances and her affairs in order. But recently, things have changed,’ the filing said.

‘Ms Spears is now outspoken in her frustration with the level of control imposed by a conservatorship, and has pleaded with this Court to ‘let her have her life back.”

He also stated that his legal team do not believe she requires further psychological assessment – something that will come as a relief to the singer, who publicly objected to another evaluation.  

Judge Penny is yet to respond to Jamie Spears’s latest petition.
